Siddique Kappan’s mother passed away while not being able to see her son one last time. Natasha’s father passed away while his daughter was still incarcerated. Fr.Stan Swamy died waiting for his bail and to be with his own. The truth is, in all these cases, the judges saw this journeys in the course of the trial. They saw the sickness, the criticality, the hospitalisation and eventual death of the mother, the father and the FATHER. But they refused to listen to their conscience and act bold.
Modi-Shah failing us is expected. The state machinery working in tandem with Shah is expected. What we are dealing with judiciary becoming an extended arm of the state, buying into NIA’s arguements and procrastinating freedom to the activists. And so, India, the powerful nation on earth is scared of a bunch of students protesting in universities. Judiciary bought the arguenent that an 84 year old Jesuit priest suffering Parkinson’s could destabilise the mighty government. All this while mobs Lynch lonely guys, beat up women with justice system looking the other way.
We are a cowardly nation. We can rant and bully Pakistan while not even naming China. We are scared of facing a independent reporter. We believe a tweet can put hake our sovereigninty into question. We feel that Hinduism can be threatened by a bunch of Islamists and Jesuits. We look powerful with images of being surrounded by a hundred NSG commandos and feel powerful.
The government is doing what it is expected to do. The bureacracy is working as an extended arm of the state. The real failure is our judiciary. They have given up on us. They have submitted themselves to the whims of the state. They are holding on to the last straw of an argument to work against the citizens and our rights and favour the State
It is the judiciary that really failed us.
